Terms and Conditions for Consumer Purchases

These terms and conditions for consumer purchases (the "Terms") apply to all consumer purchases of any model of Alpineworks swiss ("us" or "we"), hammocks and accessories offered by Alpineworks swiss (collectively, "Leisure Goods"), and/or related accessories or other products offered by Alpineworks swiss. By purchasing Alpineworks swiss products, whether online or in our showroom, you agree to these Terms in their entirety.

1. Application

These Terms apply to your purchase of the Products and use of the Hammocks. Other interactions you have with Alpineworks Swiss are subject to separate agreements, including the following:

2. Online orders, in-store orders for leisure goods

If you purchase recreational items (e.g., hammocks and accessories) (i) through online ordering or (ii) at an Alpineworks swiss retail store (as opposed to a direct purchase of an in-stock item in-store), your order for products constitutes an offer to purchase. Alpineworks swiss will send you an email acknowledging receipt of your order. Alpineworks swiss will be deemed to have accepted your order upon shipment of the recreational items. We reserve the right, at any time, even after we have sent you a confirmation email, to refuse or cancel your order or to limit order quantities for any reason, including error or suspected fraud. We will refund any prepayments we may have received from you.

Special offers, discount codes and promotions
Alpineworks Swiss reserves the right to impose limits on the combining, stacking, and use of any Alpineworks Swiss promotions conducted through the website, email, social media, or other channels where Alpineworks Swiss promotions are explained and/or disseminated. Alpineworks Swiss reserves the right to discontinue all promotions, codes, and referral programs for sales and for any new product launches. Promotional codes (i) must be used at the time of purchase, (ii) cannot be used retroactively, (iii) cannot be accumulated, (iv) cannot be used jointly, etc. For a returned product ordered using a promotional code, the value of the discount code will be deducted from the refund value.

Restrictions on leasing orders
Please note:
Discount codes, special offers, free gifts or similar promotions apply exclusively to direct purchases through our online shop.
Leasing orders (e.g., through JobRad, Bikeleasing, mein-dienstrad.de, etc.) are excluded from participating in such promotions. This is due to the fixed pricing and billing models of our leasing partners, and is non-negotiable.

3. Terms/Restrictions of the Refer a Friend Program

To qualify for a gift card, the referred customer must (i) be a new customer, (ii) provide the referring customer's name at the time of purchase, (iii) make a purchase on www.alpineworks-swiss.com for an amount greater than the minimum purchase amount specified in the referral offer, and (iv) not use any other active promotions or discounts with their purchase. Referred customers will receive a referral gift card after the referral is confirmed and the referral credit is approved by a customer service representative. Customers can refer up to two (2) people per household. Referred customers can only earn one (1) referral credit per referred customer. If a referred customer returns a purchased product and the value of their lifetime order falls below the minimum purchase amount, the referral credit awarded to the referring customer will be voided. Customers cannot refer someone who has an existing www.alpineworks-swiss.com account with a different email address.
Abuse of this offer, as determined by us in our sole discretion, may result in the cancellation of (i) the referring customer's referral credit, (ii) the referred individual's promotional code, and (iii) both parties' ability to participate in this or future promotions. Referral credit cannot be applied to past purchases and is not redeemable for cash. This referral program may be modified or terminated at any time without notice at our sole discretion.

4. Shipping

Shipping costs vary depending on the items purchased. Shipping costs will be calculated at checkout. For more information about shipping costs, please visit the shipping information page at www.alpineworks-swiss.com/shipping . Please note that pallet freight orders may incur additional charges.
In-stock orders typically ship within two (2) business days. A shipping confirmation email will be sent to the email address provided with the order once the order has shipped.

We ship your order via DHL or a specialized shipping company (curbside delivery). We do not ship to PO boxes.

Orders for discounted products may take an additional forty-eight (48) hours to process.

Any changes you make regarding shipping after the item has been shipped, including, but not limited to, changing your address, placing an order on hold, or updating your shipping settings/preferences, may delay your receipt of the products, replacement items, and/or refunds.

We will cover the return shipping costs if: (a) the products are faulty or misdescribed; (b) we have notified you of an impending change to the product or these terms and conditions, an error in pricing or description, a delay in delivery due to events beyond our control, or because you have a legal right to do so because we have made something wrong. In all other cases, you are responsible for paying your own shipping costs for returning the product. In addition, we may, at our sole discretion, arrange the return for you. Shipping costs are non-refundable. We recommend using a trackable shipping service and purchasing shipping insurance. We cannot guarantee that we will receive the product you wish to return.

For any shipments made by third parties outside of Alpineworks Swiss's normal shipping process, Alpineworks Swiss cannot provide any additional shipping data or documentation.
Orders placed through our online store ( www.alpineworks-swiss.com ) with the shipping address of the Alpineworks swiss retail location may be canceled if the retail location does not offer the "buy online and pick up in store" service. To purchase products in-store, please locate an Alpineworks swiss showroom near you.

5. Property

All products ordered by you remain our property until we have delivered the products to the address specified in the order.
If we have not received full payment for the Products prior to delivery, the Products will remain our property until payment is received in full. We reserve the right (without prejudice to applicable law) to prohibit you from using the Products and to enter your premises and repossess the Products (or have a third party do so) if payment is not made when due, or if the credit/debit card company refuses payment or requires us to reverse any payment made for the Products for any reason.

6. Your right of cancellation and return policy

Right of Cancellation for Consumers : If you are a consumer (i.e., you are not purchasing the Product(s) in the course of your business, trade, or profession), you have the right to cancel your order for the Products within thirty (30) days without giving any reason. The cancellation period expires after thirty (30) days from the day on which you or a third party other than the carrier designated by you takes physical possession of the Products.

Hammock Returns : To return a non-defective or damaged hammock, you must contact Alpineworks Swiss within thirty (30) days of receiving the hammock. The hammock must be undamaged, free of wear, dirt, dust odor, or other signs of use, and in the same condition in which you received it. If picked up by our partner, the hammock must be securely packaged for shipping.

Non-returnable items : Used products and gift orders cannot be returned unless they are faulty.

Procedure :
To exercise your right of cancellation or return, you must:

  • notify us (using the contact details provided in Section 16 of these Terms) that you wish to cancel or return;
  • Take a photo of the item in its original packaging to send to our product support team.

Refunds :
We will refund all payments we have received from you in relation to your order.
We may deduct from the refund any loss in value of the products caused by you or incurred during return shipment to Alpineworks Swiss.
We will make such a refund using the same means of payment you used for the original transaction, unless you expressly agree otherwise; you will not incur any charges as a result of such a refund. We may withhold reimbursement until we have received the Products back or until you have provided evidence of having returned the Products, whichever is earlier.
For any items returned with an order where a code was used, the full value of the discount code will be deducted from the refund amount.
We will refund you promptly and no later than:

  • Thirty (30) days from the day on which we receive the products back from you, or
  • (if earlier) thirty (30) days from the day on which you provide evidence that you have returned the Products to us, or
  • if no products have been delivered to you, fourteen (14) days from the day on which we were informed that you wish to cancel the order.

7. Repairs and spare parts

Customers may take their Alpineworks Swiss hammocks to a specialist shop of their choice for repairs. Before initiating any repairs or replacing parts, the customer must contact Alpineworks Swiss via email and obtain authorization to cover the associated costs. Alpineworks Swiss will provide the necessary replacement parts free of charge, subject to pre-approval. It is important that customers return the replaced parts to Alpineworks Swiss.

Customers who purchase spare parts or materials without prior approval from Alpineworks Swiss are solely responsible for any resulting costs. Alpineworks Swiss will not cover any costs for spare parts or repairs performed without our prior approval.

8. Product performance

Please note that the data regarding the expected service life or load capacity of our hammocks is an estimate and not a guarantee. Many factors contribute to actual use, such as frequency of use, weather conditions, loading, care, and storage. Under appropriate conditions, it is possible to achieve a shorter or longer lifespan than expected. Any changes, modifications, or other alterations you make to a hammock after purchase that affect its safety or functionality will void the limited warranty and are at your sole risk.
Alpineworks Swiss guarantees that the products:

  • correspond to the description of the products on the website (Alpineworks swiss reserves the right to use replacement parts, materials or equipment of equivalent quality and value that meet the strict standards of Alpineworks swiss) and
  • of satisfactory quality, free from defects in materials and workmanship and suitable for the intended purpose.

9th prize

The price of the products:

  • is the price that was shown on the order pages when you placed your order;
  • is in CHF or EURO (€) (EUR);
  • includes VAT at the applicable rate for products shipped within the European Union;
  • does not include VAT or customs duties for products shipped to Norway, Iceland and
  • does not include the cost of delivering the products (if you would like delivery options and costs, please visit the “Shipping” page on the website www.alpineworks-swiss.com/versand ).

10. Payments

In accordance with the "Orders" section above, payments may be declined or refunded to you for any reason or no reason at Alpineworks Swiss's sole discretion. If we accept a pre-order for a product, your account, credit card, or other payment method will be charged upon Alpineworks Swiss's approval, regardless of when your purchase is expected to ship. If a credit card chargeback of any amount is issued for an order, the applicable limited warranty for that order will be suspended until the chargeback is resolved.

11. Liability

These terms and conditions exclude our liability (if any) for:

  • Damage caused by intentional or grossly negligent conduct on the part of Alpineworks Swiss.
  • Any matter in respect of which it would be unlawful for Alpineworks Swiss to exclude or limit its liability (including any mandatory provisions under applicable law).
    Alpineworks swiss shall not be liable for any (i) consequential or indirect damages and/or (ii) loss of profits, revenue, business opportunities, loss of goodwill and/or loss of anticipated savings that you may incur.
    You may have other rights granted by law, and these Terms do not affect them.

We conduct a thorough inspection of each product to ensure its quality before shipping it to you. Upon receipt of your product, you are responsible for inspecting all parts yourself. Please note that we assume no responsibility for accidents resulting from failure to inspect after receipt.

12. Recognition and compensation

You acknowledge that there are inherent, expected, and unexpected risks and hazards associated with the use of our recreational products, whether intended or resulting from misuse. You understand that such risks may result in injury, physical, or mental harm to you, your property, third parties and their property, or to Alpineworks Swiss's property. You agree to indemnify and hold Alpineworks Swiss and its directors, officers, employees, agents, shareholders, partners, suppliers, and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party, related to or arising out of: (a) your purchase or use of any products; (b) your violation of these Terms; or (c) your violation of any third-party rights or applicable law. Alpineworks Swiss reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such event, you will fully cooperate with Alpineworks Swiss in asserting any available defenses.

13. Assignment by Alpineworks Swiss

Alpineworks swiss has the right to assign these Terms at its sole discretion without notice to you, as long as our performance of the contract is not affected.

14. Changes

We may need to change these Terms from time to time, for example, due to a change in the law. A copy of the most recent version of the Terms can be found on our website www.alpineworks-swiss.com .

15. Continuation and separability

If any part or provision of these Terms is found to be invalid, unenforceable, or inconsistent with applicable law, that part or provision shall be ineffective, to the extent that the prohibition or unenforceability does not invalidate the remaining provisions of these Terms. Terms that by their nature are intended to survive the term shall survive termination or expiration.

These Terms and any dispute between you and Alpineworks swiss will be governed exclusively by and construed in accordance with the laws of the Netherlands, excluding its conflict of law provisions, unless you reside in the EU or the United Kingdom. In that case, the consumer protection laws in your country of residence may contain non-contradictory provisions that are more favorable to you. In that case, those provisions may govern. The 1980 Vienna Convention on Contracts for the International Sale of Goods (CISG) does not apply.
Disputes can be submitted for online dispute resolution to the European Commission's online dispute resolution platform: https://ec.europa.eu/odr/
You may bring legal proceedings relating to these Terms in a competent Dutch court. If you are a consumer and reside in the European Union, you may also bring legal proceedings relating to the Terms in the competent court of your country of residence. If you reside in the European Union, we may only bring legal proceedings against you in your country of residence, unless you are acting as a business, in which case you submit to the exclusive jurisdiction of the Dutch courts.
